Facebook Declares War on IsAnyoneUp.com

Facebook has “declared war” upon the semi-interesting blog, IsAnyoneUp.com, for breaching it’s TOS. Now, this statement sounds really effing boring when you’ve never been to IsAnyoneUp.com before. What this blog has become infamous for is posting nude mobile photos of people alongside a screen shot of their real Facebook profile. Something that becomes mildly more interesting when band members from groups such as Glassjaw and Panic at The Disco! are also included in their naked ranks. This is currently allowed with the profile owner’s consent, but aye there’s the rub. Many updates to IsAnyoneUp have come in via a more vengeful avenue, and complaints have rolled in from mortified ex-girlfriends who find their tits under their profile pic.

Hunter Moore, proprietor of IsAnyoneUp, was sent this cease-and-desist letter by Joseph Cutler in representation of Facebook.com. The letter specifically cites Moore’s violations of Facebook’s TOS in these areas:

IsAnyoneUp uses Facebook Profile pics- Publishing screenshots from Facebook that contain personally identifiable information
about Facebook users without first obtaining the users’ written consent to publish the
screenshots.

- Publishing screenshots of a Facebook user profile without first obtaining the written
consent of the creator of the profile.

- Collecting information from other Facebook users without obtaining their consent,
making it clear you (and not Facebook) are the one collecting their information, or
posting a privacy policy explaining what information you collect and how you will use it.

- Threatening, harassing or intimidating other Facebook users.

The keystone in this raunchy scheme, is Facebook cannot speed up due process. The Awl has reported that IsAnyoneUp.com was clearing $13,000 a month at the end of November this year. So, you can imagine how much he has already made off of his 2 year registration back in August of 2010. Anyone with a brain would squeeze out as much time our legal system has to offer before complying, and continue to make exponentially more money off of the buzz Facebook has graced upon them. Not to mention, IsAnyoneUp.com only relies on it’s tie to Facebook as a gimmick. Now that the site has gained worldwide popularity, it can continue to post as many user submitted nude photos as it wants without any aid from the Social Media monolith. Regardless of losing it’s ability to use Facebook sharing tools, web ranking and review sites, such as StumbleUpon and Reddit, will also continue to stream traffic straight to Hunter Moore’s T&A matinee.

In essence, we don’t think Hunter really gives a crap what Mark Zuckerberg thinks anymore. Does this sound similar to how Zuckerberg staved off the Winklevoss twins until Facebook was too big for them to battle? Whoops, too soon?
